Can someone give me a reason to NOT have a sex offender registry?

It’s a few years now since Derryn Hinch came to the US, trying to get support for an Australian version of Megan’s Law. Unbelievably, it’s still not a thing in Australia. Western Australia has a form of a publicly accessible list, and while it’s a start, I still don’t think it’s as good as the ones I have available here in the US.

At the time Derryn came to the US, I was in Texas. Texas has a phenomenal Sex Offender registry. You can search by name, address, or see the most wanted sex offenders. When we had an exchange student, we were able to look at the map, and see names, photos and addresses for sex offenders on her route to school. We didn’t alarm her, we just told her there was a couple places she should avoid. There was no vigilantism, there was no picketing, there wasn’t burning bottles thrown at people’s houses. It’s just a tool, like any other, that lets you stay informed, and keep your kids safe.

We’ve moved to Florida, and they are way more pro-active here. They put up signs out the front of people’s houses in some counties. There are hundreds of pretty licence plates for cars here, with everything from the space shuttle to manatees on them, but if you’re a registered sex offender, you have one choice. Lime green. Makes it pretty easy to spot a sex offender cruising past a school… Their driver’s licence also identifies them. Schools here make visitors sign in with ID. This clearly identifies an unwanted.

I want someone to give me a valid reason Australia doesn’t have a sex offender registry. A real reason. Not some bullshit excuse about vigilantes. There’s 300 million people here, and everyone has access to the sex offender registry, and there is NO hunting of pedophiles. There’s no burnings at the stake. There’s no vigilantism. I call bullshit on that excuse.

The other excuse I constantly hear is about how some poor 18 year caught sexting with his 16 year old girlfriend ends up on the sex offender registry, and has to pay for life for their one indiscretion, and you know, “kids are kids”. I’m going to call BS on this one too. Every single sex offender tries to play this card. They were all some poor teenager caught with their girlfriend. Nobody ever admits they raped a kid. Matt’s mom had a kid who moved in next door to them, who was on the sex offender registry. In Texas, they’re legally obliged to tell the neighbours they’ve moved in. They tried to pull the whole “it was a misunderstanding with his girlfriend’s parents” crap, but a quick look at the sex offender registry, which actually tells you what the person did, let us know he raped a 12 year old.

Here’s the other thing about the US registries. They actually list what the offence was. They don’t name the victim, or go into explicit detail, but you can see whether someone really did get caught with their close to consensual girlfriend, or if they violently raped a child, or a man, or a woman. If you really did get popped for sexting, wouldn’t you want people to be able to see that, instead of just being a general sex offender?

Seriously, there is no reason to object to a sex offender registry. It’s a tool for keeping everyone safe, not just kids. Australia needs to step up and start protecting the innocent, not the offenders. People should be allowed to make decisions on how to keep themselves and their families safe, and you can’t do that without information.

Sentencing

What will he get?

I’m sitting on my couch in my RV, watching a show on E! about how celebrities cover up scandals. It’s showing how if you’ve got enough money, you can cover up almost anything, which I’ve seen first hand. More scary though, is how even after the scandals are exposed, people forgive them because, well, they’re famous. Look at Roman Polanski, OJ Simpson, Kobe Bryant, Mike Tyson. All violent offenders, and yet, still fawned over. How many people need to say they were molested by Michael Jackson before someone is believed? How many pedophiles are running around Hollywood, molesting kids, and nobody will talk about it? When people like Corey Feldman talk, they’ve got people like Barbara Walters accusing him of ruining an entire industry. Yeah Babs, go ahead and blame the victim. I’m so glad she’s retiring.

I’m pretty lucky I was given the opportunity to speak out. I didn’t want to when I was first asked. I had long left the industry, and didn’t want to be dredging up old shit. But when one of the kids in my class had an incident, it made me so mad. It was like all the rage I had buried came flooding back to the surface. When Stephen contacted me again, I knew I had to talk. People who are still working aren’t going to talk. It’s a career killer. I didn’t have a career, so I didn’t have anything to lose. Or so I thought…

Im not going to sugar coat it. The last 4 years have been tough. First, I had to think about everything I had tried to forget. I had to deal with the emotions of seeing all the people from the past again. Of seeing people who let it happen as a kid because they liked working suddenly popping up wanting to say something now like they care. Or worse, saying “Oh I had no idea.”

I feel bad for people who had to deal with me over those 4 years. Poor Stephen copped a lot of shit from me. Many days I resented him for bringing all this up. He was always super brutally honest with me, and some days I just wasn’t up for it. Sorry Stephen…. I am grateful to you, please know that.

The other thing I am grateful for, is that since my case has been so public, I know, or at least I really hope, that nobody will ever let Robert near their kids again. In Texas, Robert would be put on a publicly accessible sex offender registry. Anyone who cared to see if there was an offender near them would see his name, face and charges.  I feel bad for people in Australia who don’t get to know what kinds of creepers live next door.

I was so happy to help Derryn with his Megan’s Law campaign. I would desperately like to see a public sex offender registry implemented in Australia. I think it very fitting that the day after Robert is sentenced, Derryn will be starting his Walk For Justice.

I’ll be interested to see what Judge Zahra gives Robert. He can only sentence him based on what he would have received back in the day. I know it will be a dreadfully small sentence. Hopefully it will point out just how far we have come, and how we’ve come to recognize that those old sentences just didn’t do justice to the crime at all.

Whatever the outcome, I think there are many girls sitting at home, grateful we’ve made it this far. Grateful we were finally listened to, that he was charged. We are stronger for having faced him. Court was brutal, but we made it through. We can make it through anything after that.

What is wrong with courts in Australia?

When rapists are let off, and journalists are jailed…

There was an awful story in the paper today about a girl who was raped for years by her father, she made it to court, and the piece of shit was let off by the judge on a good behavior bond. This man raped his own child for five years. He even raped her in the bed with the mother there. Yet somehow, the judge feels that he didn’t deserve jail time.

Even worse, this isn’t an isolated case. Time after time, Judges are not even giving the minimum sentence to rapists and child molesters. They are continually giving them a simple slap on the wrist, and then, once they’ve been to court, they are protected by the courts. The names and crimes are suppressed. The community doesn’t know who these sexual deviants are. They are allowed back into the community, where they are free to continue their predatory ways.

Meanwhile, people like Derryn Hinch, who dare to try to protect the community, by naming and shaming some of these people, gets sent to jail. He was arrested again last week, because he named a man who was on parole, and should have been back in jail. Instead, the man was out, and he raped and murdered another woman.

Can somebody please explain to me why somebody who rapes a child is allowed to go free, while someone who names a rapist is sent to prison? Where is the logic? Why do we keep protecting these people? Why are we so concerned about the rights of these people, who clearly aren’t concerned about the rights of their victims?

Something needs to be done. We can’t continue to allow sexual predators a free pass, while punishing those who try to make the world a safer place.

Side note: I wonder how a lawyer can feel so concerned for the rights of the victim in the above case, when the following day he’s representing somebody charged with rape? How can you honestly represent both sides of the debate? Can you really give your all to a victim of a rapist, and the next day argue that another rapist is innocent?

WTF Australia? Sending Derryn to Jail?

I know many Australians hate the fact that I’ve become “Americanized” and now have a mixed accent. But there are times when I really do think that the US has got something smarter going on than Australia.

Like today, I’m glad I live in the US.

 I am so saddened to hear that they have decided to find Derryn Hinch, a man who has spent so many years defending small children, who has put his freedom on the line to name and shame pedophiles is now going to face jail time again, especially when he’s already fighting for his own life.

What a joke. How many times have we heard judges say we should show mercy to pedophiles who are on their death bed, or who are just simply old. Yet here, a man who is fighting to let the truth out, trying to protect more children from being abused is going to die in jail. Still, he keeps his sense of humour, by stating that they won’t get five years out of him.

Meanwhile, in the US, anybody who is charged with an offence against a child goes onto a sex offender register. This is a publicly available list. There’s even an iPhone app that I have on my phone that will pinpoint my location, and tell me if there are registered sex offenders close by. When an offender moves into a neighbourhood, and it has to be a certain distance from school, churches, etc they then have to go around and let the neighbours that they are a registered sex offender. At work, we received a letter informing us that a sex offender had moved in nearby. It was mandated by law. People don’t conduct a witch hunt. They are simply informed, so that they know not to let their kids play with the offender.

The identities of the victims are protected. On the registrer, it has a photo of the offender, as well as what type of offense they were charged with. When we had our exchange student, we noticed there was an offender listed as living on the way she walked to school. We informed her, so she could stay clear of him and his house. No big dramas. Just a heads up.

In Australia, we protect pedophiles. We allow them to continue molesting more children. We don’t empower parents to protect their kids. We don’t give them the simplest thing to save their kids from years of pain; information.

Derryn, I applaud all you have done over the years to help kids. You are an incredibly brave man. I wish I had come to you back when we both worked at Channel 7. You would have done something about it.

Stay strong Derryn. Fight till the end. I’ll be fighting alongside you.
